Unborn Victims of Violence Act 2004

Project Vote Smart's Synopsis: Vote to pass a bill that would make it a criminal offense if a fetus/unborn child is injured or killed while carrying out a violent crime on a pregnant woman.
Official Title of Legislation: HR 1997: To amend title 18, United States Code, and the Uniform Code of Military Justice to protect unborn children from assault and murder, and for other purposes.
Highlights: -Provides that offenses against the mother and against the fetus/unborn child shall be counted as separate offenses (Sec. 2).
-Provides that a conviction under this act does not require proof that the offender had knowledge of the woman's pregnancy or that the offender intended to harm the fetus/unborn child (Sec. 2).
-Provides that the death penalty cannot be imposed for an offense against a fetus/unborn child as defined in this act (Sec. 2).
-Exempts legal abortions from the provisions of this act (Sec. 2).
